Yaax Carbon, with address at Canoa 521, Floor 10, Tizapán San Ángel, Álvaro Obregón, Mexico City 01090 (the “Address”), is responsible for the use and protection of your personal data. In compliance with the Federal Law on the Protection of Personal Data Held by Private Parties (the “Law”), its Regulations and the Privacy Notice Guidelines, we make available to you our privacy notice, which can be consulted at yaaxcarbon.com, in order to guarantee the protection of your personal data. If you share personal data with Yaax Carbon, it will be understood that you have read and accepted the terms of the Privacy Notice and that, for any controversy or claim arising from it, you submit to the jurisdiction of the competent courts in Mexico City.
Yaax Carbon will process the personal data collected to the extent necessary, appropriate and relevant for the fulfillment of the following purposes: (i) preparation of proposals for services and fees; (ii) provision of professional services and compliance with obligations; (iii) sending newsletters, information notes, memoranda, reports and information, (iv) carrying out procedures and consultations related to the proposals and services requested or contracted; (v) carrying out the necessary or convenient acts to achieve the objectives set out in each matter, from the identification of property owners, negotiation and signing of contracts, verification of information for the holding of assemblies and acts related to the matters in which we intervene; (vi) procedures for the selection and hiring of personnel, collaborators, suppliers and contractors, (vii) tax and billing of services provided, and (viii) any other compatible or analogous to the above or necessary to fulfill our corporate purpose and obligations under our responsibility.
Yaax Carbon will collect from each owner the personal data it deems necessary for the purposes indicated, including, but not limited to: (i) identification and contact data: name, address, marital status, nationality, date of birth, signature, landline and cell phone number, email, CURP, and other information necessary to identify and contact the Owner; (ii) professional or work data: profession, employment or occupation, address, telephone, work email and other information necessary to know the activity, commercial or business line to which he/she is dedicated; and (iii) patrimonial or financial data: RFC code, tax address and other information necessary to issue or request receipts, debit notes and invoices for the services provided. In order to comply with the purposes set forth in this Privacy Notice, Yaax Carbon does not need to collect sensitive personal data.
Yaax Carbon undertakes not to transfer or disclose the personal data of the owners, except when it is necessary, appropriate and relevant to fulfill the purposes of the treatment established herein. Yaax Carbon will adopt and implement the necessary procedures and measures to prevent the unauthorized use or disclosure of the personal data of the holders. By way of example and not limitation, Yaax Carbon may transfer or disclose the personal data of the holders to its clients, partners, directors, agents, officers, collaborators and employees in general, external advisors and consultants, creditors, business partners, suppliers and third parties that provide services to it. The consent of Yaax Carbon will not be necessary for the transfer of your personal data in the cases provided for in article 37 of the Law.
The holders have the right to revoke their consent, limit the use or disclosure of their personal data, at any time, by means of a written request sent to contacto@yaaxcarbon.com or submitted to the Yaax Carbon Address. The request must contain: (i) the name and email of the owner, (ii) a copy of an official identification of the owner or his legal representative and, where applicable, the documents proving his status, (iii) a clear and precise description of the scope of his revocation or limitation, and (iv) other circumstances that facilitate the location of his personal data. Within 20 business days following receipt of the request, Yaax Carbon will respond to it, by email that will be sent to the address indicated by the owner, on the understanding that it will take effect and become effective within the following 15 business days. The owner must consider that, for certain purposes, the revocation of his consent will imply that Yaax Carbon cannot continue to provide services, or the conclusion of his relationship with us.
